1. Global policy and definitions

1.1 These Rate Alert Terms (the “Terms”) are a global policy. They apply to every person who creates or receives a rate alert through velafi.com, wherever that person is located, whether or not they hold a VelaFi account.

1.2 In these Terms:

  • “VelaFi”, “we”, “us” means VelaFi Group, that is, NEBULA NETWORK S.A DE C.V, Galactic Holdings Inc., Galactic Assets S.A., Galactic Colombia S.A.S., Momentum Pagos S.A.C., Velafi Digital Sociedade Prestadora de Servicos de Ativos Virtuais LTDA. together with its subsidiaries and affiliates that operate under the VelaFi brand. The Service is provided and your personal data is controlled by Galactic Holdings Inc. Where you hold a VelaFi account, the VelaFi entity that provides your account is the one named in your Account Terms.
  • “Service” means Rate Monitoring Alerts, the free tool that lets you choose a currency pair and a target rate and receive an email when the rate reaches that target.
  • “Account Holder” means a person who has opened and holds an active VelaFi account after completing our onboarding and verification process.
  • “Visitor” means a person who uses the Service without a VelaFi account, using only an email address.
  • “Account Terms” means the terms and conditions that govern a VelaFi account and the transactions made through it.

2. Accepting these Terms

2.1 Before you create an alert, you must tick the box confirming that you have read and accept these Terms and acknowledge our [Privacy Policy] and [Cookie Policy]. If you do not accept them, do not use the Service.

2.2 You must be at least 18 years old and have legal capacity to accept these Terms.

3. How the Service works

3.1 You choose a currency pair and a target rate. When our systems detect that the rate has reached your target, we send an alert to the email address you gave us.

3.2 Visitors must confirm their email address through the link we send them. An alert is only active after that confirmation.

3.3 The Service is free. We may limit the number of alerts per person or email address, and the currency pairs available, which may vary by country.

4. If you do not have a VelaFi account

4.1 Using the Service does not make you a VelaFi customer and does not create an account, a client relationship, or any obligation for VelaFi to provide you with any financial, exchange, payment or virtual asset service.

4.2 If you want to make a transaction, you must first open a VelaFi account and complete our onboarding and verification process, which includes identity checks and eligibility review under applicable law. Only then can a rate available on our platform be applied to your transactions, under the Account Terms.

4.3 For Visitors, the rates shown and sent through the Service are for information purposes only. VelaFi is not responsible if that rate, or any similar rate, is not applied to you by any bank, exchange, platform or third party.

5. Alerts are information only. They do not lock or guarantee a rate

5.1 An alert tells you that the rate reached your target at the exact moment our systems detected it. It is a snapshot of that moment and nothing more.

5.2 Exchange rates and virtual asset prices move constantly and can change from one second to the next. The rate in an alert may no longer be available when you open the email, log in, or place an order.

5.3 An alert does not reserve, hold, lock or guarantee any rate, amount or availability. It is not an offer, a quote, or an order.

5.4 The “Trade now” button in an alert email takes you to a normal order on our platform. If you place an order, it will be executed at the live rate shown at the time you confirm it, which may be better or worse than the rate in the alert, plus any applicable fees, under the Account Terms.

5.5 Any future product that holds or locks a rate for a set period will be governed by its own specific terms. Nothing in these Terms gives you a locked or guaranteed rate.

5.6 The Service is not financial, investment, tax or legal advice, and it is not a recommendation to buy, sell or exchange any currency or virtual asset. You are solely responsible for your decisions.

6. Which rate you see

6.1 Visitors see a general market reference rate. It is indicative only, is calculated from sources we choose, and may differ from the rate applied to any specific account or transaction.

6.2 Account Holders who are logged in see the rate that applies to their own account at that moment. That rate may still change before an order is confirmed, and fees and limits under the Account Terms apply.

7. Delays, missed alerts and availability

7.1 We do not guarantee that an alert will be sent, received or read at any particular time, or at all. Alerts may be delayed or missed, for example because of market volatility, data provider issues, system maintenance, email filters, or errors in the email address.

7.2 After an alert email is sent, that alert will not send another email for 24 hours, even if the rate reaches your target again during that period.

7.3 We may modify, suspend or discontinue the Service, or any currency pair, at any time, including in specific countries, with or without notice.

8. Managing and deleting your alerts

8.1 You can delete your alerts at any time from your account, from the link included in each alert email, or, for Visitors, from the browser where the alert was created.

8.2 For Visitors, we use a browser cookie that lets you see and manage your alerts on that device. If you delete the cookie or use another device, use the link in your alert emails.

8.3 We may delete alerts that are not confirmed within 30 days, that remain inactive for 3 months, or that are used in breach of these Terms.

9. Availability by country

9.1 The Service is not an offer or solicitation of financial, exchange, payment or virtual asset services in any country where VelaFi is not authorised to provide them, or where such an offer would be unlawful.

9.2 Access to transactions through “Trade now” depends on the products available in your country of residence and on your eligibility under the Account Terms.

10. Acceptable use

You must not access or use the Service through robots, scrapers or other automated means, create alerts for email addresses you are not authorised to use, resell or redistribute the information provided, or interfere with the Service’s operation or security.

11. Personal data and communications

11.1 We process your email address, your alert settings and the cookie data described above to provide the Service, in accordance with our [Privacy Policy] and [Cookie Policy].

11.2 Alert emails are service messages you asked for. We will only send you marketing communications if you separately agree to receive them, and you can opt out at any time.

12. Liability

12.1 To the maximum extent permitted by applicable law, VelaFi is not liable for any loss or damage, including lost profits or opportunities, arising from the use of the Service, from delayed, missed or inaccurate alerts, or from rate movements between an alert and any later transaction.

12.2 Nothing in these Terms limits any rights you have under mandatory consumer protection or data protection laws of your country of residence.

13. Relationship with other terms

13.1 For Account Holders, these Terms supplement the Account Terms. These Terms govern alerts. The Account Terms govern any order or transaction, including those started from “Trade now”. If they conflict on a transaction, the Account Terms prevail.

14. Changes to these Terms

We may update these Terms. We will publish the new version on this page with its date. If you keep using the Service after a change, you accept the new version. If you do not agree, delete your alerts.
