By registering and using the services provided by VelaFi, the user hereby represents and warrants that they possess full legal authority, capacity, and proper authorization to act on behalf of any company, entity, or third party whose accounts, financial information, or banking credentials are registered, linked, or operated within the VelaFi platform.
The user expressly acknowledges and agrees that all instructions, transactions, and banking operations executed through VelaFi are performed under their sole responsibility and with the corresponding authorization required under applicable Mexican laws and regulations, including but not limited to financial, anti-fraud, and anti-money laundering provisions. Therefore releases VelaFi from any liability, claim, or damage that may arise in the event that such authorizations are not obtained or these declarations become false.
The user further declares that:
They have obtained all necessary corporate approvals, mandates, powers of attorney, or internal authorizations required to operate bank accounts and perform financial transactions on behalf of such entities.
All information provided to VelaFi is true, accurate, and complete.
By accepting this disclaimer, the user irrevocably releases, discharges, and holds harmless VelaFi, its affiliates, partners, and any participating financial institutions in partnership with VelaFi, from any and all claims, disputes, liabilities, damages, or complaints, including but not limited to allegations of fraud, unauthorized transactions, or misuse of funds, arising from or related to:
The user’s lack of authorization or misrepresentation of authority.
Any instructions or transactions initiated through the VelaFi platform.
Any interaction, integration, or communication between VelaFi and banking institutions.
The user acknowledges that VelaFi acts solely as a technological platform facilitating financial operations and does not assume responsibility for verifying the internal authorization structures of its users or their represented entities.
This disclaimer shall be governed by and construed in accordance with the applicable laws of the United Mexican States. Any dispute arising from or related to this agreement shall be subject to the alternative resolution methods such as authorized arbiter, hereby waiving any litigation via civil and court systems in order to expedite resolution, with an arbiter appointed by the service provider.
By continuing to use VelaFi, the user confirms their full understanding and acceptance of the terms set forth herein.
